You Apply Where You Live — Not Where You're From
This is the single most misunderstood rule in the Spain student visa process. Getting it wrong means your application goes to the wrong consulate — and gets rejected before it is even assessed.
Apply at the consulate covering your legal place of RESIDENCE
The rule is straightforward: you apply at the Spanish consulate with jurisdiction over your current legal place of residence — the country (and region within that country) where you are legally living right now. Your nationality is irrelevant to this determination.
If you are a US citizen living in Texas, you apply at the Houston consulate — not New York, not Los Angeles, not any other US consulate. If you are an Australian citizen living in London, you apply at the London consulate — not the Sydney or Melbourne consulate. If you are a Canadian student currently on a UK Tier 4 student visa in Edinburgh, you apply at the Edinburgh consulate — not anywhere in Canada.

General Rules for Determining Your Consulate
Five rules that cover the vast majority of situations. If your circumstances are unusual, contact the relevant consulate directly — they will confirm jurisdiction.
- You apply at the Spanish consulate covering your legal place of residence — the country (and region within that country) where you are registered or legally living — not the country of your passport or nationality.
- Your residence jurisdiction is determined by your registered address, including your current visa status. If you hold a student visa in the UK, you are legally resident in the UK regardless of your nationality, and must apply in the UK.
- If you have recently moved countries, you may need to apply at the consulate covering your new place of residence — even if your previous consulate had already begun reviewing your application. Always check with the new consulate before submitting.
- If you are currently a student in a country other than your home country — for example, a Nigerian student on a UK Tier 4 student visa — you apply at the Spanish consulate in your current country of legal residence (the UK), not in your home country (Nigeria).
- If you are genuinely unsure which consulate covers your area, contact the potential consulates directly by email or phone. Provide your address, ask which consulate has jurisdiction. They are accustomed to this question and will confirm promptly.
When in doubt: contact the consulate before applying
Submitting an application to the wrong consulate — even unintentionally — wastes time and money. Consulates are not obliged to forward your application. A quick email or phone call confirming jurisdiction before you apply costs nothing and eliminates a significant risk.
